Is getting legal advice about a dispute expensive?
This depends on your legal problem. Often a lawyer can tailor a scope of works which suits your budget and objectives. Most lawyers will charge either an hourly rate or a fixed fee and should give you an estimate before you engage them.

Will I recover my costs if I become involved in a dispute?
It is rare that one party would voluntarily agree to pay another party’s legal costs, but it can happen.
If your matter ends up before a court, the court can order the other party to pay your costs, but this is up to the court’s discretion. Ordinarily, if costs are ordered, they will not cover your entire legal costs paid to a lawyer. Also, a court may order that you pay another party’s costs if you are unsuccessful, or even if you are successful, based on how the court proceedings have been undertaken.
Can I claim for my time and stress?
It is unlikely that you will be able to recover money for those types of matters, but you should not let that discourage you from asking, as in limited cases recovery may be possible.
How long does litigation take?
This varies depending on the complexity and type of dispute, how cooperative the other party is, and the availability of the court. At Parisi Foley Law, we know that a fast and effective resolution is best for all parties. We do our best to help you achieve it.
Do I have to attend court myself?
Sometimes you do have to personally attend and give evidence, which can be stressful. We have decades of experience between us and can prepare you for what to expect. We will support you every step of the way.
Do I have to provide all my documents to the other party?
Any claim you make needs to be supported by evidence. Sometimes, this can involve delving deep into your business records, which may be overwhelming and uncomfortable. We will be upfront with you from the beginning about the type of evidence you will need to supply and why. We will support you every step of the way.
Are dispute resolution processes confidential?
Mediation and arbitration are generally confidential processes, unlike court proceedings, which are usually public.
